Terms of Service

Welcome to Liftbabes. These Terms of Service ("Terms") form a legally binding agreement between you and Liftbabes LLC, a Delaware limited liability company ("Liftbabes," "we," "us," or "our"), governing your use of liftbabes.com (the "Site") and any purchases you make.

By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By using the Site, you represent that you meet this requirement.

2. Account Registration

You may purchase as a guest or create an account. If you create an account, you are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately of any unauthorized access.

3. Products

We sell silicone breast inserts ("push pads") and related accessories. Product descriptions, images, and colors are provided for illustration. Actual products may vary slightly due to manufacturing tolerances and screen color rendering.

Liftbabes products are intended for cosmetic and aesthetic use only. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition.

Do not use if you have:

  • Open wounds, cuts, or skin infections in the chest area
  • Active dermatitis, eczema, or known silicone allergies
  • Recent surgery or unhealed surgical sites in the chest area
  • A pacemaker or other implanted medical device that may be affected by adhesives

If unsure, consult a physician before use.

4. Pricing and Payment

All prices are listed in USD unless stated otherwise. Prices may change without notice. Payment is processed through Stripe at the time of order. By placing an order, you authorize us to charge the payment method provided.

We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or stock unavailability. In such cases, we will issue a full refund.

5. Order Acceptance

Receipt of an order confirmation email does not constitute acceptance of your order. We reserve the right to verify, modify, or cancel orders before shipment.

8. Intellectual Property

All content on the Site — including the Liftbabes name, Lifties product name, logo, designs, photographs, text, and graphics — is the property of Liftbabes LLC or licensed to us. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

9. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose
  • Submit false or misleading information
  • Attempt to gain unauthorized access to the Site or other users' accounts
  • Use automated means (bots, scrapers) to access the Site
  • Interfere with the Site's operation or security
  • Reverse-engineer or copy our products

10. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, LIFTBABES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted or error-free, or that products will meet your specific expectations beyond their described function.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LIFTBABES LLC AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY) ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain damages, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Liftbabes LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of products, or your violation of any law or third-party right.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution First

Before filing any claim, you agree to contact us at support@liftbabes.com to attempt informal resolution. We will respond within 30 days. Most disputes can be resolved this way.

Binding Arbitration

If informal resolution fails, all disputes between you and Liftbabes shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, or via telephone/video conference at the customer's election.

Class Action Waiver

YOU AND LIFTBABES AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. If this class action waiver is held unenforceable, the remainder of this arbitration provision shall be void.

Exceptions to Arbitration

Either party may bring claims in small claims court for disputes within that court's jurisdiction, and either party may seek injunctive relief in court for intellectual property infringement.

Opt-Out

You may opt out of this arbitration agreement within 30 days of your first purchase by emailing support@liftbabes.com with the subject line "Arbitration Opt-Out" and including your full name, address, and order number.

15. Modifications

We may update these Terms at any time. Material changes will be posted on this page with an updated "Effective Date." Continued use of the Site after changes constitutes acceptance.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and Liftbabes regarding your use of the Site.
